Litigation is an essential legal process in family law matters when out-of-court attempts at resolution were not successful, when the preservation of legal rights is at stake or when the safety of an individual and/or children are at risk.

Litigation refers to any process that uses the court system to make decisions during a family law matter. Litigation involves starting a court proceeding, filing various legal documents, and having the matter heard by a Judge in court.

To resolve all matters relating to dissolving a marriage or modifying an existing agreement, parties must go through the court.  Litigated matters can proceed even if both parties do not agree on the process.

If there is a history of violence, immediate risk, power imbalance, high conflict, financial withholding and/or dishonesty, litigation may be the legal process recommended to you by our firm.
