Legal Separation
A legal separation determines custody, support and property/debt division, but the two parties remain married to one another.
When contemplating divorce, at least one spouse must be a resident of Nebraska for one year. Separation in this case is an alternative to divorce while the parties live apart but remain married to one another.
Prenuptial
A prenuptial agreement is a legal contract entered into by two parties before they get married that outlines each individual's assets and specifies how financial issues will be handled in case a divorce occurs.
Child Support
The issue of child support comes up in cases involving divorce, custody and paternity. Our clients often have questions about Nebraska child support and how much the amount paid or received is determined, when it starts, when it stops and how/if it can ever be changed. We can answer all of these questions and more.
Alimony
Spousal support is one of the most challenging aspects of divorces in Nebraska.

Grandparent Rights
Grandparents have limited rights under Nebraska law, but there are situations in which grandparent may be able to successfully petition for temporary custody, guardianship or merely the right to visit their grandchild.
Name Change
A maiden name can be restored as part of the divorce process for a spouse. Alternatively, the change can be petitioned after divorce, but this action requires a formal hearing in front of a judge. This is true for the restoration of a maiden name outside of the divorce proceeding, change of legal name for any reason, including those of minor children. We can guide you through the process and support your wishes.
Paternity
Legally establishing paternity is important when considering the best interests of a child and the father’s rights and obligations related to their child. Paternity is a crucial component in cases involving divorce and separation, custody, estate planning and adoption.
Modification
After divorce, families evolve, grow and change. People change jobs, even careers. Children grow older and have different needs. Situations present themselves that were entirely unforeseeable at the time of a judgment.
If there has been a substantial change of circumstance, the court may allow modifications to orders that reflect the changes and transitions a family may have experienced.
Removal
Circumstances often change after a divorce decree or parenting plan has been entered. Remarriage and employment are two of many reasons a parent may want to move out of state. The parent wishing to relocate must seek the court’s permission to alter the custody arrangement to move the children from one state to another.
Protection Orders
A protection order is issued by a judge when a person has been accused of abusing, sexually assaulting or harassing another person. What type of order is issued depends on the relationship between the accused and the person seeking the order and the type of behavior reportedly at issue.
Adoption

Parenting Plans
A parenting plan is a legal document that details everything related to a child or children’s life after a divorce or separation. It includes an explanation of the parenting time schedule, in which home a child mostly resides, which parents holds decision-making authority and what the agreements are between parents regarding education, religion, medical care choices and more.
Child Custody
Child custody refers to the rights of a parent to provide care for their child and make legal decisions that affect their child; known as physical and legal custody. Many factors go into determining custody including whether custody is shared or if sole custody is in the better interest of the child.
Custody issues can arise from divorce cases, nonmarital cases, grandparents’ rights cases and the need to change an existing child custody arrangement.
Contempt Proceedings
Contempt proceedings can be filed to enforce a court order when a party has repeatedly and knowingly failed to comply with the court order. We can assist you in navigating the contempt process.
LGBTQ Family Law
Although the states of Nebraska and Iowa recognize same sex marriage; LGBTQ family law, like most family law, is not simple.
We work with all types of families at McGill Law and we understand that LGBTQ families often have additional complications both legal and emotional that are not common in other family law cases. Fortunately, our experienced team is ready to address all aspects of LGBTQ family law cases.
